Acceptable Use Policy

This Acceptable Use Policy is part of, and incorporated into, the avoClerk Terms of Service. We wrote it narrowly: the Service is built for a specific use — answering inbound calls for U.S. law firms — and we will enforce that scope.

Who may use the Service

U.S.-licensed law firms in good standing in every jurisdiction where they hold themselves out as practicing. You may grant access to authorized employees and contractors who reasonably need it to handle calls and intake. You are responsible for those users. You may not resell or sublicense without our written consent.

What the Service is for

  • Answering inbound calls placed to phone numbers you provision through us.
  • Performing AI-driven intake conversations with callers.
  • Recording and transcribing calls (subject to the consent mode you select).
  • Routing messages, scheduling, and basic informational responses.

That is the scope. Anything outside it, treat as outside the AUP unless we say otherwise in writing.

Region restrictions

Illinois. The Service does not currently serve callers with Illinois area codes (217, 224, 309, 312, 331, 447, 618, 630, 708, 773, 779, 815, 847, 872). The block is implemented at the inbound webhook before any audio reaches our speech-to-text or AI components. You may not configure, modify, or use the Service to circumvent this restriction. See the Recording & AI Disclosure Policy for the rationale (Illinois BIPA).

Telephony and consent

  • No outbound dialing of any kind, including telemarketing, cold-calling, robocalling, prerecorded-message campaigns, or appointment-reminder broadcasts. The Service is inbound-only.
  • No campaign-style use of numbers on the FTC National Do Not Call Registry, a state DNC list, or your own internal DNC list.
  • No FDCPA debt-collection. The Service is not configured for FDCPA compliance.
  • No spoofing, forging, or misrepresenting caller-ID, calling party identity, or routing metadata.
  • No suppressing, weakening, hiding, or contradicting AI identity disclosure, by prompt customization or otherwise. AI disclosure is mandatory on every call.
  • No suppressing recording disclosure where the per-firm consent mode requires it; no continuing recording after a caller has declined consent.

Practice of law and bar rules

  • No use in any U.S. jurisdiction where the firm is not licensed, or in any matter constituting the unauthorized practice of law.
  • No configuring the Service to provide legal advice, render legal opinions, predict case outcomes, quantify damages, or commit the firm to representation.
  • No use violating your state bar’s rules of professional conduct, including ABA Model Rules 1.1, 1.6, 5.3, 5.5, and 7.1–7.3 (or analogues).
  • No solicitation in jurisdictions where in-person or live- telephone solicitation is restricted, except as permitted.
  • No communicating with a person you know to be represented by other counsel without that counsel’s consent.

Restricted industries and content

  • No non-legal commercial activities (we are a legal-vertical product).
  • No adult content, gambling, weapons sales, illegal drugs, regulated investment advice, multi-level marketing, or comparable elevated-risk categories.
  • No fraud, scams, money-laundering, sanctions violations, or evasion of export controls.
  • No use exposing a caller to physical, financial, emotional, or reputational harm.
  • No discrimination or facilitation of unlawful discrimination.

Security and platform integrity

  • No reverse engineering, decompiling, or attempting to derive source code or model weights.
  • No unauthorized vulnerability scanning or probing.
  • No bypassing authentication, rate limits, or security measures.
  • No prompt-injection, jailbreak, or model-extraction attacks.
  • No malware, phishing, or harmful content.
  • No scraping, screen-scraping, or bot access except via our published API.
  • No interfering with or disrupting the Service or other customers.

Data hygiene

No feeding the Service Protected Health Information under HIPAA, classified information, controlled unclassified information, payment-card numbers (other than via our Stripe billing flow), Social Security numbers as a routine matter, or other regulated data we have not, by separate written agreement, agreed to handle. The Service is not HIPAA-compliant and we do not sign Business Associate Agreements at this time.

The “unlimited minutes” line

Our pricing offers “unlimited” inbound minutes for typical lawful use by a U.S. personal-injury or similar firm. That excludes:

  • Sustained call volumes outside the range of normal inbound demand for a firm of your stated size.
  • Concurrent-channel saturation beyond the dashboard limit for your plan.
  • Robocall barrages directed at your DIDs that you do not actively work to mitigate.
  • Call-stuffing or revenue-share fraud schemes.
  • Use as a transcription/TTS/LLM endpoint rather than an inbound-call answering service.

Enforcement

In ascending order: notice, throttle, suspend, terminate. We choose the level proportionate to the violation and risk, and may skip levels for security, abuse, legal, or reputational threats.
